THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.2709 of 2017 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue writ of Mandamus to declare the action of the respondent in billing tie petitioner under 11 KV Voltage Category instead of 33 KV Voltage Category as highly illegal, arbitrary, unjust and void and also violative of the Fundamental Rights guaranteed to the petitioner under Articles 14, 19(1)(5), 21, 265 and 300-A of the Constitution of India."
Heard, Sri D.V. Nagarjuna Babu, learned counsel for the petitioner and Sri R. Vinod Reddy, learned Standing Counsel for respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner herein, the petitioner herein submitted a representation on 09-01-2017 to the 3rd respondent herein and no orders have been passed on the said representation so far. It is further submitted by learned counsel for the petitioner that without any notice to the petitioner the respondents had changed the voltage category from 33 KV to 11 KV. Since the issue is pending before the 3rd respondent, this Court deems it appropriate to dispose of the present writ
petition with a direction to the 3rd respondent to take appropriate action on the representation, dated 09-01-2017 said to have been submitted by the petitioner herein, by fixing some timeframe.
For the aforesaid reasons, the writ petition is disposed of, directing the 3rd respondent to consider and pass appropriate orders on the representation, dated 09-01-2017 said to have been submitted by the petitioner herein, in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. Till the said exercise attains finality, status quo as regards the power supply to the petitioner firm shall be maintained.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
