The case of the petitioner that he was issued a showcause notice dated 16-04-2014 directing him to showcause as to why the punishment of stoppage of three annual grade increments with cumulative effect should not be imposed against him. On that the petitioner submitted explanation on 18-09-2014. But no orders are passed. Meanwhile, the juniors to the petitioner are promoted and the petitioner is denied the promotion because of pendency of disciplinary proceedings. Aggrieved by the same, the present writ petition is filed.
Learned counsel for the petitioner submits that the Government has issued a circular memo No.695/Ser.C/2006, dated 12-10-2006 observing that in case of allegation of non-submission of annual property returns, the punishment that can be imposed is 'censure' and learned counsel for the petitioner says that the case of the petitioner is also entitled for the benefit of that memo, since the allegation against the petitioner is also non-filing of annual property returns.

Since already a show-cause notice was issued to the petitioner and explanation is also filed, it is for the competent authority to consider the same and pass orders. In view of the same, the competent authority is directed to consider the explanation of the petitioner in terms of circular memo No.695/Ser.C/2006, dated 12-10-2006 and pass appropriate orders within a period of two months from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 21-08-2017 Nvl
