HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27084 of 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents 2 and 3 in not entertaining the on-line application of the petitioner for grant of pattadar pass book and title deeds in respect of land admeasuring Ac.0.25 guntas in Survey No.248/AA, situated in Velugumitla Village, Khammam Urban Mandal, Khammam District as illegal and arbitrary and for a consequential direction to the 3rd respondent to entertain the on-line application of the petitioner dated 28.06.2016.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Revenue produced written instructions dated 06.09.2016 in Rc.No.B/3228/2016 wherein it is stated that the G.O.Ms.No.153, dated 03.06.2016 relied on by the petitioner shall be applicable only to the agricultural lands located in rural areas but not in urban areas. It is also contended that until the so called unregistered sale deed is validated no pattadar pass books can be issued. It is stated that petitioner's application is rejected vide proceedings dated 06.09.2016.

In view of the same, no relief can be granted. However, it is open for the petitioner to challenge the said proceedings dated 06.09.2016 if he is so aggrieved. Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 17.09.2016 tk
