THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.2670 OF 2017 ORDER:

This criminal petition, under Section 437 and 439 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to enlarge the petitioner/A.2 in Crime 76 of 2016 of Chinturu Police Station, East Godavari District, registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act'), as he is in judicial custody since 19.11.2016.

The sole ground urged before this court is that the mother of the petitioner/A.2 was expired on 23.03.2017 and her cremation was over, but the petitioner being the son has to perform her 11th day ceremony, therefore, sought for bail.

Taking into consideration the facts and circumstances of the case, more particularly, about the death of the mother of the petitioner/A.2 in the above crime and his obligation being the son to perform customary rituals of his mother, I find that it is a fit case to enlarge the petitioner/A.2 on bail for a period of 15 days on his execution of personal bond for Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties for the like sum each to the satisfaction of the Superintendent of Central Prison, Rajamundry. On such execution, the Superintendent of Central Prison, is directed to enlarge the petitioner on bail, providing one escort, for a period of 15 days i.e. from 01.04.2017 to 15.04.2017.

After expiry of 15 days of enlargement on bail, the petitioner shall report before the Superintendent of Central Prison, Rajamundry.
