This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in not registering the sale transactions of the petitioner in Plot No.122 admeasuring 580 sq.yards in Sy.No.180 carved 1 Part of Yendada Village, Visakhapatnam Mandal and Distrit on the basis of a letter dated 12.04.2012 issued by the 3rd respondent, as illegal and arbitrary.

When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the present writ petition is covered by the judgment in W.P.No.40578 of 2015 dated 06.01.2016 and W.P.No.23217 of 2012 dated 12.12.2012 and the same is not disputed by the learned Standing counsel for 3rd respondent and learned Assistant Government Pleader for Revenue. For the reasons alike, this writ petition is allowed directing the Joint Sub-Registrar, Madhurawada, to receive and process the documents presented by the petitioner in respect of Plot No.122 admeasuring 580 sq.yards in Sy.No.180 carved 1 Part of Yendada Village, Visakhapatnam Mandal and District without reference to the letter dated 12.04.2012 issued by VUDA.

In the event, the documents presented are found to fulfil the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the Joint Sub-Registrar, Madhurawada, shall complete the registration formalities and release the documents in accordance with the due procedure. It is made clear that mere registration of documents would not absolve the liability of the petitioner and his successors-in-interest of legal action arising out of the enquiry that is stated to be pending with respondent No.3. There shall be no order as to costs.
