HONOURABLE SRI J USTICE N. BALAYOGI M.A.C.M.A. No. 2268 of 2009 ORDER:

When the matter was listed on 25.04.2017, none appeared for the appellant and hence, the matter was directed to be listed to 17.08.2017. On that day, learned Counsel for the appellant sought time and accordingly the matter was directed to be listed on 22.09.2017. On 22.09.2017, again none appeared for the appellant nor was made representation on his behalf. In view of the same, the matter was directed to be listed for today i.e. 25.10.2017 finally. To day also, though the matter is listed finally, none appeared for the appellant nor is representation made on his behalf both in forenoon and afternoon sessions. In the circumstances, this Court has no option except to dismiss the appeal for none prosecution.

Accordingly, MACMA is dismissed for non-prosecution. Miscellaneous petitions pending consideration if any in the appeal shall stand closed in consequence.
