HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.11451 of 2018 ORDER:
The petitioner challenges the charge memo dated 21-03-2018, wherein and whereby he was suspended from services pending enquiry on certain allegations i.e. taking bribe from the persons seeking release of agricultural service connections. The petitioner was also issued charge memo on 06-03-2018. Even before filing explanation by the petitioner, the impugned order is issued.
Learned counsel for the petitioner submits that only on false allegations, the petitioner was kept under suspension. On the other hand, Sri M.Ravindra, learned Standing Counsel for the respondents submits that on serious charges of corruption, the impugned order is passed.
It is to be seen that a reading of the impugned order goes to show that serious allegations are made against the petitioner i.e. receiving bribe. It is not the case of the petitioner that the authority who issued impugned lacks jurisdiction. Since charge-sheet is already issued, it is open for the petitioner to file explanation within a period of three months from today. On filing of explanation, it is open for the respondentauthorities to conduct enquiry in accordance with law and take action.
Since the impugned order is issued by the competent authority, I do not see any reason to interfere with the same.
Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
