Heard Mr.K.Srinivas for petitioner and the Assistant Government Pleader for civil supplies.

The petitioner challenges notification No.1067/ E/ 2016 dated 06.10.2016 insofar as Shop No.16 of Thimmarajupeta Village of Atchutapuram Mandal, Visakhapatnam District, as illegal, contrary to G.O.Ms.No.4 dated 28.02.2014.

The petitioner claims consideration and appointment as fair price shop dealer on compassionate grounds upon the demise of petitioner's father-erstwhile fair price shop dealer. It is further stated that the 2nd respondent is under obligation to consider the request and take necessary decision at the earliest. The 2nd respondent instead of taking decision has included Shop No.16 of Thimmarajupeta Village in the notification read above. Hence the writ petition.

The Assistant Government Pleader places on record the revised notification issued on 18.10.2016 and as matter of fact states that the subject fair price shop is deleted from the notification dated 06.10.2016. The statement is placed on record. The Assistant Government Pleader further submits that the 2nd respondent will consider the case of the petitioner in accordance with applicable Government Orders and take a decision at the earliest. Having regard to the above submissions, the writ petition is disposed of by this order:

The 2nd respondent is directed to consider the case of petitioner for appointment as fair price shop dealer of Shop No.16 of Thimmarajupeta Village of Atchutapuram Mandal in terms of G.O.Ms.No.4 dated 28.02.2014 within four weeks from the date of receipt of a copy of this order. The petitioner is at liberty to communicate copy of this order along with representation. No order as to costs.
