THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.31389 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue Writ, Order or direction, preferably a Writ in the nature of Mandamus by declaring the action of respondents in seizing the petitioner vehicle i.e., AP-23-Y-9597 without following due process and contrary to Rule 9-Q of A.P.Minor Mineral Concession Rules, 1966, by declaring it as being illegal, arbitrary, without any authority of law and violative of Article 14, 19 (1) (g) of the Constitution of India, and consequently direct the respondents to release the petitioner vehicle forthwith."
2. When the matter is called, it is represented by learned Government Pleader for Home that police already deposited the subject vehicle before the Court of Judicial Magistrate of First Class, Alampur vide C.R.P.No.310 of 2015 on 06.10.2015.
3. In view of the above, the writ petition stands disposed of, leaving it open to the petitioner herein to move an appropriate application before the Court of Judicial Magistrate of First Class, Alampur under Section 451 Cr.P.C for release of the vehicle. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
