HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.24429, 24430, 24474, 24490 and 24512 OF 2017 COMMON ORDER:
The case of the petitioners in all these writ petitions is that they were issued show cause notices on different dates by the Commissioner of Police of their respective regions, calling for explanation as to why disciplinary action should not be taken against the petitioners for the lapses committed by them. Thereafter, the petitioners have submitted explanations denying the allegations made in the show cause notice. But, the respondents neither passed any orders in pursuance to the show cause notice, till today, nor admitted the petitioners into duty. Aggrieved by the same, these writ petitions are filed. Heard learned counsel for the petitioners in all the writ petitioners who submits that in some of the cases, petitioners were acquitted from the criminal cases after filing of explanation before the 3rd respondent, and as such, the petitioners may be permitted to file further explanation disclosing the said fact. Heard learned Assistant Government Pleader for Services.
In view of the facts and circumstances, it is open for the petitioners who have been acquitted in the criminal cases, to file further explanation before the 3rd respondent within a period of two weeks from today. Thereafter, the 3rd respondent is directed to consider the explanations of all the petitioners and pass orders after affording opportunity of hearing to the petitioners, within a period of six weeks and take further action accordingly. Accordingly, all the writ petitions are disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petitions, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 08.08.2017 tk
