THE HON'BLE SRI JUSTICE G. CHANDRAIAH AND THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO WRIT PETITION No. 16723 of 2005 ORDER: (per Hon'ble Sri Justice G. Chandraiah) This writ petition is filed aggrieved by the order dated 10.03.2005 in O.A.No.777 of 2002 on the file of the Central Administrative Tribunal, Hyderabad.
2. The facts of the case, in brief, are that the respondent who was a Gramin Dak Sevak in Old Guntakal Post Office sought transfer to Guntakal Head Post Office as Extra Departmental Stamp Vendor, on health grounds. While so, pursuant to the notification dated 15.04.2002 for the posts of postman, the recruitment to which is through a competitive examination among Gramin Dak Sevaks, the respondent applied to the post. The 1st petitioner rejected the respondent's application vide letter dated 25.06.2002, citing that the respondent has not completed a minimum service of five years. Aggrieved by the same, the respondent filed O.A.No.777 of 2002 before the Central Administrative Tribunal, Hyderabad. The Tribunal, vide interim orders dated 28.06.
2002, directed the petitioners to permit the respondent to appear in the examination, but however, the result shall be put on hold. The petitioners furnished a detailed reply. The Tribunal, vide an elaborate order dated 10.03.
respondent may be entitled to subject to his being successful in the examination. It was further directed to report compliance within three months. Hence, this writ petition by the petitioners.
3. While admitting the writ petition on 22.08.2005, this Court dismissed WPMP No.21258 of 2005 filed by the petitioners seeking suspension of the impugned orders of the Tribunal.
4. Having regard to the nature of the order passed by the Tribunal, we do not see any reason to interfere with the orders impugned, and no orders are required to be passed in the writ petition.
5. The writ petition is, accordingly, closed. No costs. Miscellaneous petitions, if any pending, shall stand closed.
