Heard counsel for the petitioners and the Government Pleader for Land Acquisition appearing for the respondents.
2. Petitioners' grievance is that the respondents are laying a road through their land without following due process of law. 3.
The Government Pleader for Land Acquisition states that a preliminary notification for acquisition of the subject land was given under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and declaration was also issued on 07.01.2016. She further states that the 3rd respondent, who is the Land Acquisition Officer, will consider the claims of the petitioners, if they approach the 3rd respondent with the supporting documents in the award enquiry, which is being conducted by him.

In view of the said submissions, this Writ Petition is disposed of directing the Land Acquisition Officer/3rd respondent to issue a notice to the petitioners fixing the date and time of enquiry under the provisions of the above Act, treating them as persons interested in the land, within a period four (04) weeks from the date of receipt of a copy of this order; the petitioners shall produce the documentary evidence in their possession regarding their title to the subject land on the date fixed for enquiry; and the 3rd respondent shall consider the same in the award enquiry and pass appropriate orders thereon and communicate his decision thereof to the petitioners. There shall be no order as to costs.
5. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
