THE HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY CRIMINAL PETITION No. 5694 of 2024 ORDER:

This petition is filed under Sections 437 and 439 of the Criminal Procedure Code seeking to release the petitioner, who is Accused No.1, on bail in Crime No.106 of 2024 of Bhongir Town Police Station, Rachakonda Commissionerate, registered for the offences under Sections 306 and 420 I.P.C.

Heard learned counsel for the petitioner - accused No.1, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner - accused No.1 would submit that the petitioner - accused No.1 had appeared for the examination conducted by the Telangana State Public Service Commission, Hyderabad, to the post of Assistant Engineer and got 4132 rank vide Hall ticket No.2160447941. The petitioner secured 300 marks and his educational certificates will be verified on 03.06.2024. He belongs to scheduled caste community. Further, the petitioner also applied for Group - I Services and examinations are scheduled on 09.06.2024. 4.

As seen from the contents of the First Information Report, the allegation against the petitioner is that he had love affair with the

BVR,J crlp_5694_2024 deceased for a long time and he also promised to marry her; that having promised to marry her, he deceived her which drove the deceased to commit suicide. The petitioner was arrested on 16.04.2024. 5.

Taking into consideration that accused Nos.3 and 4 were granted Anticipatory Bail and six (6) witnesses have already been examined by the Investigation Officer, as stated by learned Assistant Public Prosecutor, this Court is inclined to grant bail to the petitioner - accused No.1.

In view of the above, the Criminal Petition is allowed and the petitioner - accused No.1 is directed to be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of learned Additional Judicial Magistrate of First Class, Bhongir. The petitioner shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C.

Miscellaneous petitions, if any, pending in this petition shall stand closed.
