HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.779 of 2014 ORDER:
This petition is filed to withdraw I.D.O.P.No.294 of 2014 from the file of Principal District Judge, Krishna District, Machilipatnam and transfer the same to Principal District Judge, Visakhapatnam for disposal in accordance with law.
2. Petitioner herein is wife and she filed her affidavit in support of the petition, according to which, her marriage with respondent was performed on 01.12.2010 according to Christian Customs and respondent herein filed the above referred O.P No.294 of 2014 for dissolution of marriage. She stated that she is working as Anganwadi worker at Koruprolu-II, S.Rayavaram Mandal, Visakhapatnam District and it is difficult for her to travel from her working place to Machilipatnam for defending the said O.P.No.294 of 2014. She further stated that she is having tender age child and the distance between Machilipatnam and Visakhpatnam is nearly 500 KMs and that she has no male assistance to escort her from Visakahpatnam to Machilipatnam.
She further stated that she cannot meet travel expenses from Visakhaptanm to Machilipatnam, for these reasons, she prayed for transfer of I.D.O.P. No.294 of 2014 from Principal District Judge, Krishna District, Machilipatnam to Principal District Judge, Visakhapatnam.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

5. Advocate for petitioner/wife submitted that petitioner is a
small employee working as Anganwadi worker and it is difficult for her to travel from Visakhapatnam to Machilipatnam for the purpose of defending I.D.O.P.No.294 of 2014. It is also submitted that petitioner has got a tender age child and that she has no male assistance to escort her.
6. I have perused the material papers including affidavit of petitioner filed along with transfer petition. Considering the reasons stated in the affidavit and also considering the convenience of wife, I.D.O.P No.294 of 2014 is withdrawn from the file of Principal District Judge, Krishna District, Machilipatnam and transferred to Principal District Judge, Visakhapatnam for disposal in accordance with law.
7. Accordingly, the Transfer Miscellaneous Petition is allowed. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
