THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.16193 OF 2005 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue writ of mandamus declaring the action of the respondent bank proposing to retire the petitioner on attaining the age of 56 years in pursuance of the notice, dated 30-06-2005 and also to declare that the resolution No.8 of the respondent bank, dated 21-09-2003 is in contravention of Rule 28 (V) of the A.P. Cooperative Societies Rule and direct the respondents to continue the petitioner upto 58 years of age i.e., 31-07-2007.

2. Learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition. Permission is accorded.

3. Accordingly, the Writ Petition is dismissed as withdrawn. Miscellaneous petitions, if any pending, in this Writ Petition shall stand closed.
