THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27122 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to, issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of respondent No. 2 and 5 in not action upon the representations dated: 09-05-1015, 16-06-2015, 26-06-2015 and the action of the respondents 3 to 5 in not conducting investigation in proper lines, in Crime No. 129 of 2015, dated 1805-2015, of 5th Respondent/P.S., though serious and grave injuries were received on the vital parts of the body of the petitioner as illegal, arbitrary and unconstitutional and consequently direct the respondent No. 3 to 5 to conduct investigation in Crime No. 129 of 2015, dated; 18-05-2015, in proper lines by arresting the accused in the said crime and pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case."
2. Heard Sri Rizwan Ali Shaik, learned counsel appearing for the petitioners and learned Government Pleader for Home appearing for the respondents.

A counter affidavit is filed by the Sub Inspector of Police, Samalkot Police Station, East Godavari District and Paragraph 10 of the said counter reads as under:
"10. It is respectfully submitted that as stated above this respondent being the investigating officer taking steps to detect the case and as per the evidence the investigation in Cr.No.129/2015 U/s.307 IPC will be finalized in accordance with law and an appropriate report will be submitted before the concerned Hon'ble Court as expeditiously as possible."
4. On noticing the same, learned counsel for the petitioner requested this court to dispose of the writ petition by recording the averments made in the counter affidavit and further requested this
court to direct the police to expedite the investigation.

In view of the above, writ petition stands disposed of, by recording the averments made at Paragraph 10 of the counter affidavit filed by the Sub Inspector of Police, Samalkot Police Station, East Godavari District and the respondent police authorities are directed to conclude the investigation as expeditiously as possible.
6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 16th September, 2015 ss
