HCJ&Dr.SA,J W.P.No.13777 of 2019 ORDER: (Per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The present Habeas Corpus Writ Petition has been filed by the petitioner, ostensibly on the ground that her husband, Sajid Ali, is not only being illegally detained by the police, but was also picked up on 20.06.2019, and his whereabouts are unknown. On the other hand, Mr. Santosh Kumar, the learned Special Government Pleader, states that on 03.02.2019, an F.I.R. was registered in the RGI Airport Police Station, for offences under Sections 420 and 379 I.P.C. In connection with the said report, Sajid Ali was arrested by the police on 05.07.2019. He was produced before the concerned Magistrate and has been sent to judicial custody. Presently, he is being kept in judicial custody in the Central Jail.

Therefore, according to the learned counsel, presently, the custody of Sajid Ali is a legal one. In order to buttress his plea, the learned counsel has submitted certain documents. The same shall be taken on record. Considering the fact that Sajid Ali has been arrested in F.I.R.No.53 of 2019, and has been sent to judicial custody, his custody cannot be said to be an illegal one.

For the reasons stated above, this Court does not find any merit in the present Habeas Corpus Writ Petition; it is hereby dismissed.
