THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37363 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to call for the records pertaining to FIR No.125 of 2016 and to quash the same.
Heard and perused the material available on record. The grievance of the petitioner is that one P. Venkata Sainath, the de facto complainant, lodged the present complaint alleging that the petitioner, who is A-1, cheated the complainant by creating forged documents and death certificate of one D. Venkata Ramamma (now alive), who is the grand mother of the complainant, got registered a shopping complex, situated in Yemmiganur Town in his favour and also submitted false documents to the municipal officials and got title proceedings pertaining to the shopping complex and also on 14.06.2016, at about 3.30 p.m. the petitioner along with A-2 to A-5 went to the shopping complex of the complainant and threatened him with dire consequences and to vacate the shopping complex.
Considering the grievance of the petitioner, the 2nd respondent is directed to complete the investigation in Crime No.125 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to report before the 2nd respondent daily at 10.00 a.m. from 14.11.2016 for a period of ten (10) days.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 2nd November, 2016 KL
