THE HON'BLE JUSTICE SRI T. SUNIL CHOWDARY SECOND APPEAL No.815 of 2000 JUDGMENT:

This second appeal is filed under Section 100 CPC assailing the judgment and decree dated 08.08.2000 passed in A.S.No.126 of 1998 on the file of the Court of the IV Additional District Judge, Guntur, partly allowing the appeal by setting aside the judgment and decree dated 27.07.1998 passed in O.S.No.717 of 1996 on the file of the Court of the I Additional Senior Civil Judge, Guntur. The learned counsel for the appellants submitted that the learned counsel for the respondent filed a memo reporting that respondent Nos.1 and 2 died. He further submitted that he addressed a letter to the appellant to secure the details of the L.Rs of respondent Nos.1 and 2. He further submitted that in spite of his best efforts, the appellant is not cooperating to take appropriate steps to bring the L.Rs of respondent Nos.1 and 2 on record. It appears that the appellant is not interested to prosecute the matter.

Hence the second appeal is dismissed. No order as to costs. As a sequel, miscellaneous petitions, if any, pending in this appeal shall stand dismissed.
