ORDER: (Per VVA, J) Heard learned counsel for the petitioner and learned Advocate General.
2. This writ of Habeas Corpus is filed alleging that the son of the petitioner viz., Pinniboina Subba Rao, was detained by respondent No.5 from 19.05.2015 in connection with an offence relating to theft of sheeps.
3. Learned Advocate General, on instructions, has produced a copy of FIR No.42 of 2014 on the file of Chillakallu Police Station for the offence under Section 411 IPC, wherein the said Pinneboyina Venkata Subba Rao is shown as A5, who is stated to have been already arrested on 25.05.2015 and was produced before the learned Judicial Magistrate of First Class, Jaggaiahpet on 25.05.2015 and is stated to be on judicial remand.
4. In view of the registration of FIR and judicial custody of the said detenu, it cannot be said that there is illegal detention unwarranted under law. Hence, the writ petition is dismissed. Petitioner, however, are at liberty to take appropriate remedy in accordance with law. As a sequel, the miscellaneous applications, if any, shall stand closed.
