HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39071 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in FIR No.63 of 2016 on the file of the 2nd respondent. 2.

Heard and perused the material available on record. 3.

The above case was registered for the offence under Sections 323, 506 IPC and Sections 3 (i)(r )(s) of SCs & STs (POA) Act. It is alleged that the petitioner assaulted the 3rd respondent and insulted him by referring to the name of his caste, whereas it is the case of the petitioner that he is a student and his father is actively participating in politics and the people, who are inimical towards his father got lodged the present complaint with false allegations.

The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, considering the grievance of the petitioner, without expressing any opinion on merits, the official respondents are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioner. If any final report is filed before the Court concerned and if summons are issued to the petitioner, he shall appear before the Court concerned and execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the Court concerned, as surety for his future appearance in the case concerned.
