HONOURABLE SRI JUSTICE GUDISEVA SHYAM PRASAD. WRIT PETITION No. 200 OF 2016 O R D E R :

This writ petition is filed seeking a writ of mandamus to declare the inaction of the third respondent in not proceeding with the investigation in F.I.R.No. 294 of 2014 of Nagarapalem Police Station, Guntur Urban as illegal and arbitrary. The petitioner has also sought for a direction to the third respondent to complete the investigation as early as possible.

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

3. The learned counsel for the petitioner submits that the petitioner has approached the higher authorities several times but they have not taking any steps to expedite the investigation in this matter; and therefore, filed the present writ petition.

4. The learned Assistant Government Pleader for Home submits that she received instructions from the concerned Police stating that on 02/03/2015 they have filed a memo before the Special Mobile Court, Guntur seeking to obtain the specimen signatures of the petitioner and accused to forward

them to hand writing expert for comparison with the documents in question. The Police have also filed another memo on 26/11/2015 before the Special Court, Guntur for the same relief and the orders are awaited.

However, in the light of the facts and circumstances of the case and in view of the submissions made by the learned Assistant Government Pleader, the concerned investigating agency particularly respondent No.3 is directed to expedite the investigation by obtaining necessary documents from the known sources and in that process the petitioner is directed to co-operate with the investigation.

6. With the above observation, this writ petition is disposed of accordingly. No costs.

7. As a sequel, miscellaneous petitions if any, pending in this writ petition stand closed.
