HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2546 of 2017 ORDER :

This criminal petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') to enlarge the petitioner/A.2 on bail in the event of his arrest in connection with Crime No.317 of 2016 of Chaitanyapuri Police Station, registered for the offences punishable under Sections 420, 468 and 471 read with 34 IPC apprehending his arrest.

After arguing the matter for some time, Sri Kiran Palakurthy, learned counsel for the petitioner, requested this Court to permit the petitioner to surrender before the XI-Metropolitan Magistrate, Ranga Reddy, and on such surrender, if any application is filed for grant of bail under Section 437 Cr.P.C., after serving notice on the Assistant Public Prosecutor, the learned Magistrate may be directed to decide the petition on the same day.

Acceding the request of the petitioner, without going into the merits of the case, I deem it appropriate to direct the petitioner to surrender before the XI-Metropolitan Magistrate, Ranga Reddy and on such surrender, if any application is filed under Sections 437 or 439 Cr.P.C., after serving notice on the Assistant Public Prosecutor, the Presiding Officer is directed to decide the petition on the same day in accordance with law.

With the above direction, the criminal petition is disposed of. 5.
