When the present appeal was called on 02.09.2016, there was no representation for the appellants. Since, the present appeal is preferred against dismissal of Suit for specific performance of agreement of sale and relates to the year 1999, Registry was directed to list the matter under the caption 'for dismissal'.

2. Today also, there is no representation for the appellants. In fact, the present appeal was dismissed against respondent No.1 for default on 17.12.2008 and no steps have been taken yet, to get it set aside.

3. Since, there is no representation for the appellants, the present appeal is dismissed for non-prosecution. Miscellaneous Petitions, if any, pending in this appeal, shall stand closed. There shall be no order as to costs.
