HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.25890 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioner challenging the E-Auction Sale Notice dated 15.07.2015 issued by the respondent-Bank in exercise of powers under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, proposing to sell the secured assets of the petitioner in the auction to be conducted on 18.08.2015, as arbitrary and illegal.

2. When the matter is called for hearing, learned Standing Counsel for the respondent-Bank, submits that the auction could not be conducted on 18.08.2015 for want of bidders.

3. In view of the said submission, as E-Auction Sale Notice is under challenge, we are of the view that the cause in this writ petition does not survive for adjudication. 4.

Accordingly, this writ petition is dismissed as infructuous. Interim order granted by this Court on 17.08.2015 is vacated. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
