HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITON No.13799 of 2019 ORDER:

This Writ Petition is filed seeking to issue a writ of Mandamus declaring the inaction of respondent Nos.2 and 3 in arresting the accused in Crime No.72 of 2017 on the file of Kulkacherla Police Station, Vikarabad District, as illegal and arbitary. Heard Sri Rajagopallvan Tayi, learned counsel for the petitioner, and the learned Government Pleader for Home appearing for respondent Nos.1 to 3.

Learned Government Pleader for Home based on the written instructions, dated 08.7.2019, would submit that upon receipt of the complaint, a case in Crime No.72 of 2017 was registered on 18.10.2017 and the investigation was taken up. In the course of investigation as no evidence has comeforth in support of the allegations made by the complainant and as no prima facie case was established against the accused, respondent No.3 addressed a letter, dated 25.8.2018, to the Sub-Divisional Police Officer, Parigi, to refer the case as 'Lack of evidence'. Learned Government Pleader would further submit that the Sub-Divisional Police Officer, Parigi, vide proceedings No.205/RFR/SDPO-P/VKB/2018, dated 31.8.2018, has accorded permission to refer the case as 'lack of evidence' and that after serving a notice to the complainant, final report will be filed before the Court concerned.

Recording the above submissions of the learned Government Pleader and as no cause survives for adjudication, the Writ Petition is closed, leaving it open to the petitioner to avail appropriate legal remedies available to him in law against the said final report. As a sequel, Miscellaneous Petitions, if any, pending shall stand dismissed. No order as to costs.
