HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13800 OF 2019 ORDER:
This writ petition is filed aggrieved by action of respondent No.4 in calling the petitioner to police station and harassing him to settle the issue in respect of Crime No.397 of 2019 though he is not an accused.
Learned Assistant Government Pleader for Home produced written instructions stating that the petitioner was called to the police station on 29-06-2019 in respect of Crime No.397 of 2019, under Sections 419, 420, 468 and 471 IPC as he was suspected in the said case and enquired him. During enquiry, the petitioner was asked about sale deeds and other documents. It is also denied that the Sub-Inspector of Police forced the petitioner to settle the issue and also made him to wait in the police station from 9.00 am to 9.00 pm. It is also stated that except on 29-06-2019, the petitioner was never called to the police station again. Learned counsel for the petitioner says that due to pressure from the police, the petitioner is hospitalized.
In view of the same, the writ petition is disposed of directing the respondents not to interfere with the life and liberty of the petitioner and not to pressurize him to settle the civil disputes. However, this order will not preclude the respondent-police from investigating into crime and to take action in accordance with law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
