This appeal suit and the appeal suit - A.S.No.2810 of 2004 arise out a common judgment.

Today, A.S.No.2810 of 2004 is dismissed as abated for not brining on record the legal representatives of the sole appellant therein. In this appeal also, no steps are taken to bring on record the legal representatives of the deceased sole appellant despite lapse of more than 90 days from the date of death of the sole appellant. Therefore, this appeal stood abated automatically on expiry of 90 days from the date of death of the sole appellant and no appeal is pending since 91st day from the date of death of the sole appellant.
