THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.14508 OF 2014 ORDER: (per the Hon'ble Sri Justice Sanjay Kumar) This writ petition is filed assailing the action of the transport authorities of the State of Andhra Pradesh in seizing the Jaw Crusher and Prime Mover of the petitioner company under check report dated 3.5.2014.

By interim order dated 15.5.2014, this Court directed the respondents to release the seized vehicles of the petitioner company on the condition of depositing a sum of Rs.2,50,000/- (Rupees two lakhs fifty thousand only) with the Regional Transport Authority, Kadapa, and also giving an undertaking that it would produce the vehicles as and when required in the enquiry and would not transfer or alienate the vehicles pending the enquiry.

Though a counter affidavit has been filed by the respondents touching upon merits of the matter, this Court is not inclined to adjudicate the issues raised in this writ petition as the Regional Transport Authority, Kadapa, is admittedly seized of the enquiry.

In that view of the matter, the writ petition is disposed of directing the Regional Transport Authority, Kadapa, to conclude the enquiry, after giving due opportunity of hearing to the petitioner company, within a period of four weeks from the date of receipt of a copy of this order. The amount deposited by the petitioner company pursuant to the interim order dated 15.5.2014 shall abide by the result of such enquiry.

Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
