HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39815 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the 2nd respondent to register a crime on the basis of her complaint dated 18.11.2015. 2.

Heard and perused the material available on record. 3.

The petitioner lodged a complaint in the year 2015 alleging that his relative viz., P. Ravi Yadav came to her house along with two bulls and demanded money as per the custom prevailed in that area. The father of the petitioner refused to pay the amount. Then, the paternal uncle of the petitioner, his sons and P. Ravi Yadav beat her father. The petitioner has not subsequently lodged any complaint alleging about the said occurrence. 4.

Considering the facts and circumstances of the case, this Court is of the view that if the petitioner has any grievance against the persons alleged in her complaint dated 18.11.2015, she is at liberty to file a fresh complaint against the said persons. On such complaint being filed, the official respondents are directed to register a case, if the complaint discloses any cognizable offence. If the official respondents fail to do so, the petitioner is at liberty to avail the remedies that are available under Code of Criminal Procedure.

Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 30th November, 2016 Nn
