HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13796 OF 2019 ORDER:

The only grievance of the petitioner is that respondents are not following the mandate of law in the provision of Section 41-A Cr.P.C. and binding principles in the judgment of Arnesh Kumar v. State of Bihar1 while investigating into the case in Cr.No.107 of 2019, dated 13-06-2019 registered by the Station House Officer, Miryalaguda I Town/4th respondent herein, against the petitioner, for the offences punishable under Section 3 (1) (r) (s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

It is stated by learned counsel for the petitioner that in similar circumstances, this Court disposed of WP.No.14106 of 2018, dated 07-04-2018.

Heard learned Assistant Government Pleader for Home. In view of the same, the writ petition is disposed of directing the Station House Officer, Miryalaguda I Town Police Station/4th respondent herein to follow the statutory mandate in Section 41-A of Cr.P.C. and the precedential guidelines in Arnesh Kumar's case (supra) while investigating into the aforestated crime.
