WRIT PETITION No. 12089 of 2018 ORAL ORDER:

Petitioner claims that his father cultivated land to an extent of Ac. 9.43 cents in survey No. 490/2, Chakirala village, Kanigiri mandal, Prakasam district during his life time and on his death petitioner is in peaceful possession and enjoyment of the same. According to petitioner his father instituted O.S.No. 40 of 1991 on the file of District Munsif Court, Kanigiri seeking permanent injunction which was dismissed by order dated 7.4.1977. Aggrieved thereby, he filed A.S No. 16 of 1997 in the Court of Senior Civil Judge, Kandukur and the same was allowed by judgment dated 29.12.2003 granting permanent injunction.

In the year 2001, when petitioner made a representation to the Tahsildar-4th respondent to enter his name in revenue records he came to know that subject property is registered in the name of 6th respondent and pass books were fraudulently issued to him. Petitioner claims to have submitted representations to Tahsildar to cancel the pattadar pass books issued in favour of 6th respondent. Alleging inaction petitioner complained to the District Collector on 06.02.2017 and requested the District Collector to direct Tahsildar to act on his representation. Since, no action is taken so far, he filed the present writ petition. Petitioner prays to direct 4th respondent to enter his name in ROR proceedings and is aggrieved in not cancelling the sale deed and mutation made in favour of 6th respondent.

Heard learned counsel for petitioner and learned Assistant Government Pleader for Revenue and with their consent the writ petition is disposed of at the stage of admission.

Learned Assistant Government Pleader submits that no application is made by petitioner so far in prescribed form for mutation of his name and for cancellation of pattadar pass book. Learned Assistant

Government Pleader would submit that petitioner has to submit online application in prescribed form through State Government web portal and only on filing such application along with supporting documents, the same would be considered. This statement of learned Assistant Government Pleader is not disputed by learned counsel for petitioner. In the circumstances, without going into merits of the matter, writ petition is disposed of granting liberty to petitioner to submit application in prescribed form through online web portal for mutation of his name and for cancellation of pattadar pass book stated to have been granted in favour of 6th respondent and on filing such an application the same shall be considered and disposed of in accordance with law after giving due opportunity to petitioner, 6th respondent and any other person interested in the subject property as expeditiously as possible, preferably within a period of eight weeks thereof.
