THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 1602 of 2017 ORDER:

Heard learned Government Pleader for Municipal Administration, Sri Y.Rama Rao, learned Standing Counsel for HMDA, Sri G.Narender Reddy, learned Standing Counsel for Panchayath Raj and learned counsel for the petitioners. With the consent of both the parties, the writ petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent Nos.1 to 3 in not initiating steps to restrain the illegal construction of compound wall and building in the existing road situated in Survey No.243 which leads to the agricultural lands of the petitioners situated in Survey Nos.251, 252, 253 and 439 of Puppalaguda Village, Gandipet Mandal, Ranga Reddy District, Telangana State as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to the respondentauthorities to consider the representation dated 10.01.2017, made by the petitioners against the encroachment made on the public road by way of raising compound wall and building.

Learned Government Pleader for Municipal Administration would submit that if there is an encroachment as alleged, definitely the authorities will take appropriate action.

Having regard to the above, the writ petition is disposed of directing the respondent-authorities to consider the representation made by the petitioners, in accordance with law, after hearing the petitioners and the

aggrieved persons, if any, at the earliest. There shall be no order as to costs.

6.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
