THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.2454 of 2014 ORDER:

This writ petition is filed to declare the action of the respondent No.2 and its officials in threatening the petitioner to demolish the front column of his house bearing H.No.1-5-77 and 1-5-77/1, situated at Mahaboobabad, Warangal District, as illegal and arbitrary.

The case of the petitioner is that the respondents are trying to demolish the front portion of the property i.e., house bearing No.1-5-77 and 1-5-77/1, situated at Mahaboobabad, Warangal District under the guise of land acquisition proceeding for laying service road to connect Railway Under Bridge(RUB); though the area covered by land acquisition notification was already acquired, the respondent No.2 is trying to remove the columns which are foundations for the entire structure and that even though the petitioner himself has voluntarily removed the structures which are covered under land acquisition and handed over same to the officials, the respondent no.2 and its officials are threatening to demolish the front column of the house of the petitioner which is not covered under the land acquisition notification. In view of the above, if the respondents intend to demolish the house of the petitioner, they are directed to follow the procedure as contemplated under law.
