THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26181 of 2017 ORDER:
Heard the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration & Urban Development (Telangana) and the learned Government Pleader for Revenue (Telangana) for respondents 1 and 2 and Sri N.Praveen Kumar for the third respondent. The grievance of the petitioner in the present Writ Petition is the failure on the part of the third respondent-Gadwal Municipality in issuing allotment letter pertaining to the lease for collection of the market fee.
When the matter is taken up, on instructions, it is submitted by the learned Standing Counsel that, despite notice dated 18.04.2017 issued by the third respondent-Gadwal Municipality, directing the petitioner herein to comply with the directions contained therein, the petitioner herein is not coming forward and not cooperating with the third respondent-Gadwal Municipality and due to which no further action could be taken. On the other hand, it is submitted by the learned counsel for the petitioner that the petitioner herein will immediately report before the Commissioner, third respondent-Gadwal
Municipality and comply with the directions contained in the notice dated 18.04.2017. The said statement is recorded. In view of the above, the present Writ Petition is disposed of, keeping it open to the petitioner to approach the Commissioner, third respondent-Gadwal Municipality pursuant to the notice dated 18.04.2017 for compliance of the conditions stipulated therein within period of one week from the date of receipt a copy of this order and, if the petitioner approaches the third respondent and complies with the conditions stipulated in the notice dated 18.04.2017, necessary formalities shall be completed by the third respondent strictly in accordance with law.
As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
