THE HON'BLE SRI JUSTICE T.AMARNATH GOUD M.A.C.M.A. No.1139 OF 2006 JUDGMENT:

Appellant-claimant filed this appeal against the Order and Decree dated 28.10.2005 in O.P.No.792 of 2002 on the file of the II Additional Chief Judge, City Civil Court at Hyderabad (for short, the trial Court), whereunder the trial Court granted an amount of Rs.22,000/- towards compensation along with interest @ 9% per anuum as against the claim of Rs.1,00,000/- on account of the injuries sustained by the appellant in the motor vehicle accident occurred on 25.02.2001.

The manner of accident and the injuries sustained by the appellant-claimant are not in dispute and the appellant challenged the impugned award only on the quantum of compensation awarded by the trial Court. Therefore, this Court is not inclined to go into other details other than the quantum of compensation. 3.

Heard.

As per Ex.A.7-discharge summary, the appellant sustained three injuries i.e., (i) lacerated wound of 3" x 1"x 1⁄2" over front of the forehead, (ii) lacerated wound of 1 x 1⁄2" x 1⁄2' over the front of the right leg and (iii) abrasion over the back of the right elbow. Taking into consideration the evidence before it, the trial Court awarded total compensation of Rs.22,000/- i.e., Rs.9,000/- towards injuries, Rs.5,000/- towards pain and suffering & extra nourishment, Rs.1,000/- towards transportation, Rs.1,000/-

towards medical attendant and Rs.6,000/- towards medical expenses, which in the opinion of this Court, are just and reasonable. Hence, I see no grounds to interfere with the order of the trial Court.

In the result, the Motor Accidents Civil Miscellaneous Appeal is dismissed confirming the order of the trial Court dated 28.10.2005 in OP.No.792 of 2002.
