THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.403 of 2017 JUDGMENT:

This appeal is filed under Section 100 CPC aggrieved by the judgment and decree dated 13.02.2017 in A.S.No.112 of 2003 on the file of the Court of Principal District Judge, Chittoor, whereby where under the judgment and decree dated 28.04.2003 in O.S.No.949 of 1997 on the file of the Court of III Additional Junior Civil Judge, Chittoor, dismissing the suit filed by the plaintiff for permanent injunction, was confirmed. 2.

At the time of hearing, learned counsel for the appellants seeks permission of this Court to permit the appellants to withdraw the second appeal and to that effect he also filed a letter dated 14.12.2017 before the Registry. Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn at the stage of admission. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
