wp_22689_2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Assailing the non-implementation of order dated 04-07-2016 in O.A.No. 4977 of 2013 on the file of the Andhra Pradesh Administrative Tribunal at Hyderabad (for short, 'the Tribunal'), the applicant therein filed this Writ Petition. 2.
At the hearing, learned Government Pleader for Services (T.S.) has placed before the Court proceedings vide Rc.No. 19701/C4/C6/2010-17 dated 01-09-2017 issued by respondent No. 1, whereby he promoted the petitioner as LFL Headmaster (T.M.) and posted him at Government Primary School, Kooche Chirag Ali, Nampally Mandal, with monetary benefits with effect from 16-12-2015. Learned counsel for the petitioner submitted that respondent No. 1 has not made re-fixation of pay scale of the petitioner by extending notional seniority as directed by the Tribunal. Learned Government Pleader for Services (T.S.) has submitted that unless the petitioner's suspension period is regularized, the said benefits cannot be given; that respondent No. 1 addressed letter dated 19-08-2017 to Government who is the competent authority to address both the said issues and that as soon as the Government does the needful, respondent No. 1 will comply with the order of the Tribunal with respect to the said two aspects.

Having regard to the aforementioned proceedings dated 01-09-2017 and the explanation submitted by respondent No. 1 for non-compliance with the pay fixation and notional seniority, the Writ Petition is closed with liberty to the petitioner to avail appropriate legal remedy in the event the respondents do not fix the pay scale by according notional seniority within one month from today.
