ORDER

This writ petition is filed seeking the following relief: "..to issue a writ, order or direction more particularly one in the nature of writ of Mandamus and declare the action of the respondents in not considering the claim of the petitioner for promotion as Deputy Executive Engineer on regular basis as arbitrary and discriminatory and consequently direct the respondents to promote the petitioner as Deputy Executive Engineer and from the date of promotion of his immediate juniors with all consequential benefits such as payment of pay and allowances from the date of promotion of his juniors etc and pass such other order or orders may deem fit and proper in the circumstances of the case."

Learned counsel appearing for the petitioner submits that during the pendency of the writ petition, the respondents have considered and rejected the case of the petitioner vide proceedings dated 4.2.2008; and that since the petitioner has challenged the consequential proceedings dated 3.3.2009 in W.P.No.14747 of 2010, the cause in the writ petition does not survive for adjudication. In view of the said submission, the Writ Petition is closed. However, the petitioner is at liberty to pursue his remedies in accordance with law.
