HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.10337 of 2015 O R D E R :
The petitioner who is accused No.3 in Crime No.203 of 2006 of Gopalapuram Police Station, Hyderabad, registered for the offences punishable under Sections 420 and 406 I.P.C. filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.
When the matter is taken up for hearing, the learned Public Prosecutor informed that the investigation is completed and charge-sheet is also filed. N.B.Ws. are also pending against the petitioner in C.C.No.628 of 2011 on the file of the X Additional Chief Metropolitan Magistrate at Secunderabad.
The learned counsel for the petitioner submits that the petitioner is not aware of the pendency of the case and he is ready to appear before the concerned court regularly and face the trial.
Considering the facts and circumstances of the case, the petitioner-accused No.3 is directed to appear before the Magistrate concerned and file petition to recall N.B.Ws. issued against him. Upon filing of such petition, the trial Court is directed to recall the warrant, pending against the petitioner, on the same day on his executing a
personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioneraccused No.3 is directed to appear before the trial Court on all hearing days without fail.
With the above observation, the Criminal Petition is disposed of.
