THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.29837 of 2016 O R D E R:

Heard counsel for the petitioner and the Government Pleader for Home appearing for respondents.

Petitioner's grievance is that when the petitioner made a complaint dt.24.08.2016 to the 3rd respondent, he declined to receive it and even when the copy of the said complaint was sent by registered post with acknowledgement due, the same was refused.

The Government Pleader for Home appearing for respondents states that the Home Guard who was on duty in the police station and who was unaware of the contents of the complaint erroneously refused to receive the postal cover containing the complaint dt.24.08.2016, and however stated that FIR No.180 of 2016 was registered on 14.09.2016 on the basis of the complaint of the petitioner.

In view of the above submission, the Writ Petition is disposed of directing the 3rd respondent to conduct investigation into the allegations leveled by the petitioner in the said complaint and file a final report before the competent Court. The respondents shall be careful in not refusing to receive FIRs lodged by the citizens, since it is their statutory duty to take action if such complaints are made.

The respondents are warned that any repetition of this conduct will be viewed very seriously by this Court. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
