HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.4887 OF 2015 ORDER:

This Criminal Petition is filed by the petitioners/A2 to A4 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.52 of 2014 of Women Police Station, Kakinada, for the offence punishable under Sections 498-A and 494 r/w 34 I.P.C.

Heard the learned counsel for the petitioners and the learned Public Prosecutor (Andhra Pradesh) for the State before notice to respondent No.1/de facto complainant and before admission.

On perusal of the material on record, as it falls short to admit the application under Section 482 Cr.P.C, this application is disposed of with the observation that the learned Magistrate shall not insist the presence of the accused already enlarged on bail pending investigation. Needless to say in the event of police filing final report under Section 173 Cr.P.C. and for any offence taken cognizance by the learned Magistrate any other remedies are left open to the accused Accordingly, this Criminal Petition is disposed of.
