HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13837 OF 2019 ORDER:

This writ petition is filed with the following prayer: "to issue a Writ, Order or direction more particularly one in the nature of "Writ of Mandamus" declaring the action of the respondents in purporting to include the petitioner institution in the TS-Ed.CET2019 counselling process ignoring the fact that the petitioner institution is a recognized minority educational institution as being illegal, arbitrary, unconstitutional and violative of Article 30 of the Constitution of India and consequently direct the respondents not to include the petitioner institution in TS.Ed.CET-2019 counselling process in the light of Minority Status Certificate granted in favour of the petitioner and direct the respondents to treat the petitioner institution as minority educational institution for all purposes and permit the petitioners to make admissions as minority educational institution and declare that and the petitioners are entitled to admit students through TS-Ed.CET-AC (SW-II) and pass such further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned counsel for the petitioners submits that the 2nd respondent issued proceedings dated 01-06-2019 calling for options and also production of some documents. In pursuance of the same, the petitioners made a representation along with necessary documents on 10-06-2019 before the 2nd respondent. But without taking any decision on the same, the 2nd respondent is trying to

include the petitioners' college in SW-I counselling process. Aggrieved by the same, the present writ petition is filed. Heard Sri A.Abishek Reddy, learned Standing Counsel appearing for respondents 2 and 3.

In view of the same, the 2nd respondent is directed to consider the representation made by the petitioners along with documents submitted them and take a decision before counselling starts and pending decision, the petitioners' college shall not be included in SW-I TS-Ed-CET2019. With the above observations, the writ petition is disposed of.
