The State Of A.P. Rep., By Its Executive Engineer, v. Gavara Padma
SMT JUSTI CE T. RAJANI MACMA.No.8 2 2 of 2 0 0 8 JUDGMENT:
This appeal is preferred by the appellants, who are respondents before the Court below, assailing the order of the District Judge, Srikakulam in OP.No.198 of 1999 dated 23.08.2004. 2.
Heard both the counsel.
3.
The counsel for the appellants submits that the appeal is filed questioning the quantum of compensation awarded by the Court below.
4.
A perusal of the order of the Court below shows that the Court below did not award excess compensation. It took the income of the deceased, who is stated to be a driver, as Rs.960/ - per month, which cannot, by any stretch of imagination, be considered high. The evidence of P.W.1 that he was earning Rs.2,000/ - per moth is also not believed. Hence, viewed from angle, the compensation granted cannot be termed as exorbitant.
The civil miscellaneous appeal is dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
