THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.26127 of 2008 ORDER:

This Writ Petition is filed questioning order, dated 23.10.2008 passed by the Andhra Pradesh Cooperative Tribunal, Visakhapatnam, in I.A.No.61 of 2008 in EOP.No.1 of 2008.

Respondent No.4 herein filed EOP.No.1 of 2008 challenging the elections conducted to the petitioner society on 29.12.2007. The EOP was entertained and notices were issued. The petitioner society filed I.A.No.61 of 2008 under Order XIV Rule 2 read with Section 151 CPC with a prayer to decide the locus standi of respondent No.4 to file EOP. By the impugned order, the said I.A. came to be dismissed.

Today, when the matter is taken up, it is submitted that the period for which elections were conducted to the petitioner society itself was for five years commencing from 29.12.2007 which would end by 29.12.2012. Inasmuch as the very EOP itself would not survive, the cause in the Writ Petition has become infructuous. Accordingly, the Writ Petition is dismissed as infructuous.

Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. There shall be no order as to costs.
