Petitioner was issued notice on 20.05.2019 by the Municipality to submit documents such as registered ownership, link documents, previous construction permission plan and proceedings approved by the Municipality/Gram Panchayat relating to House No.6-3-29/2, Old Town, Mahabubabad, as it appears, the building was affected by road widening and requires to be removed. In response to the same, legal notice was got issued on 28.06.2019, which goes to show the present status of the building used for religious purpose, but does not deal with the contents of the notice. Along with the Writ Petition, certain documents are placed to show that the valid title is vested in the petitioner and permissions are granted.

The Court is not inclined to look into the grievance of the petitioner, at this stage. It cannot be said that the Municipality is not competent to issue such notice to the petitioner. However, this Court deems it appropriate to give one more opportunity to the petitioner to submit all the documents as required in the impugned notice.

The Writ Petition is accordingly disposed of granting liberty to the petitioner to submit all the documents as required in the impugned notice within one week from the date of receipt of a copy of this order. If the documents are submitted by the petitioner in support of her claim, the same shall be considered and on

due consideration of the same, decision shall be made and communicated to the petitioner. Miscellaneous petitions, if any, shall stand closed.
