Heard learned counsel for the petitioner and Mr. A. Rama Rao, learned standing counsel for the respondents.
2. Petitioner herein was initially appointed by the respondent corporation as Coach Spare and while working, after earning promotions, as Assistant Engineer (Mechanical), he was issued with charge sheet dated 29.01.2013 and subjected to disciplinary enquiry, which resulted in punishment of reduction of basic pay by two incremental stages for a period of two years without cumulative effect under orders of respondent No.2 dated 18.10.2013. Petitioner has preferred an appeal against the said order on 10.12.2013 before the first respondent. The order imposing punishment, referred to above, is questioned in this writ petition on various grounds.
3. However, in view of the fact that the petitioner's appeal is pending with the first respondent, it would not be appropriate and just to entertain the writ petition, at this stage. Hence, giving liberty to the petitioner to raise all his contentions before the first respondent where his appeal is pending, the first respondent is directed to consider the aforesaid appeal on its own merits and after notice to the petitioner, dispose of the same within a period of two (2) months from the date of receipt of a copy of this order. The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V.
