HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 9956 of 2012 ORDER :

This writ petition is filed to declare the action of the first respondent in not considering the objections of the petitioner and others before granting trade license to the 2nd respondent for running the Bar and Restaurant at D.No.5-7-7/3, B.N.Reddy Nagar, Ranga Reddy District as illegal and arbitrary and consequently to direct the first respondent to consider the objections of the petitioner. 2.

It is the case of the petitioner that he is the resident of B.N.Reddy Nagar Colony. The 2nd respondent is running the bar in Uppal Excise limits and intended to shift the bar to B.N.Reddy Nagar near Bus stop and that he intended to establish the Bar at D.No.5-77/3, B.N.Reddy Nagar, Ranga Reddy District. Even though the entrance to the bar is situated on the main road, the 2nd respondent proposed to allot the parking area in the residential colony, which will create nuisance under intoxication. Near by the premises of the proposed bar, hostel and children's park is existing.

3. When the matter is taken up today, Sri Pasham Krishna Reddy, learned Standing Counsel for the first respondent state that as on today, no trade licence is granted to the 2nd respondent. In view of the submission of the learned Standing Counsel for the first respondent, the first respondent is directed to consider the objections raised by the petitioner and also after giving an opportunity of hearing, before granting trade licence to the 2nd respondent. With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall stand closed.
