HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.27334 of 2017 ORDER :

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

" ...to issue a writ or direction more particularly one in the nature of Writ of Certiorari quashing the FIR No.158/ 2017 dated 31-07-2017 on the file of Palakol Town Police Station, West Godavari District by calling for records and consequently direct the respondents not to harass the petitioner and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

2) Heard the learned counsel for petitioners/ A1 to A13 of Crime No.158 of 2017 of Palakollu Town Police Station, West Godavari District, registered for the offences punishable under Sections 403 and 420 r/ w 34 I.P.C. and the learned Government Pleader for Home appearing for respondent Nos.1 to 6, before ordering notice to respondent Nos.7 to 9 and perused the grounds urged in the affidavit filed in support of the petition and the contents of the F.I.R.

3) Leave about the other material, which is a part of investigation for nothing to interdict the investigation. From perusal of the F.I.R. contents, but for, petitioner No.1, the other petitioners/ accused cannot be arrested pending investigation by police. However, this will not prevent the police to secure any of them for the purpose of investigation including for interrogation pending investigation.

4) Accordingly, the Writ Petition is disposed of. All the defences of the accused are left open.
