ORDER:

This company petition is filed for an order to wind up the respondent for nonpayment of the debt due to the petitioner. On 30.03.2015, Mr.Tarun G.Reddy, learned counsel for the respondent, has placed before the Court a fax copy of letter, dated 27.03.2015, addressed by the

Managing Director of the petitioner company to the General Manager of the respondent company, wherein he has confirmed the due payment of Rs.55,39,746/- by the respondent towards full and final settlement and stated that they have no further claim. Mr. D.Narender Naik, learned counsel representing Mr.T.Vinod Kumar, learned counsel for the petitioner, requested for a day's adjournment for written instructions from his client.

Today, at the hearing, learned counsel for the petitioner has submitted that he has received confirmation from his client that the respondent discharged the debt towards full and final settlement of the petitioner's claim and that his client is not interested in pressing this company petition. In the light of the above facts, the Company Petition is dismissed as not pressed.

As a sequel to dismissal of the company petition, company application No.1472 of 2014 filed by petitioner for appointment of the Provisional Liquidator is dismissed as infructuous.
